A lawsuit against Alec Baldwin alleges that the script of the Western movie "Rust" did not require him to fire the shot that killed cinematographer Halyna Hutchins last month.

Script supervisor Mamie Mitchell, who called police after the shooting occurred on the New Mexico film set, filed Wednesday the suit.

Mitchell alleges she was in the line of fire and stated that the actor should have checked the gun himself for live ammunition rather than relying on the assistant director's assertion that the Colt .45 revolver was safe to use.

She is suing for assault, intentional infliction of emotional distress, and deliberate infliction of harm and is seeking unspecified damages, in the lawsuit filed in Los Angeles Superior Court.

According to the lawsuit, the script called for three tight camera shots, one of Baldwin's eyes, another of a bloodstain on his shoulder, and a third of his torso as he reached his hand down to the holster and removed the gun.

Mitchell's lawyer accused the actor of playing Russian roulette when he fired the gun without checking it.

The lawsuit is the second to be raised over the incident, and names 22 defendants associated with the movie including Baldwin, Rust producers, six production companies, armorer Hannah Gutierrez Reed, and First Assistant Director David Halls.

Authorities are still investigating the October 21 shooting that took place on the set of the Western movie. No criminal charges have been brought against anyone.
