The Fourth Circuit of the Administrative Court of the State Council, headed by Counselor Mohamed Ghoneimy, Vice President of the State Council, rejected the appeal filed by Zamalek Club demanding the return of the 129 feddans of land allocated to it in Hadayek October City, designated for the construction of a new branch of the club.
The appeal, numbered 5193 of the 80th Judicial Year, was filed by Captain Hussein Labib, President of Zamalek Club, against both the Minister of Housing and Urban Communities and the Head of the Hadayek October City Authority, objecting to the Authority Head's decision to withdraw the land previously allocated to the club.
During the proceedings before the State Council Court in Rehab City, the court had previously decided to postpone the appeal to a session on February 3rd to review and respond to the memoranda submitted by the parties.
The session was attended by the defense team of Zamalek Club, which included Counselor Kamal Shuaib, lawyer Mohamed Anani and a number of lawyers from the club’s legal department, where they presented an oral argument that lasted about 40 minutes, during which they argued several legal points, including the invalidity of the contested decision because it was issued – according to the club’s defense – by an incompetent authority, in addition to its violation of the real estate regulations and the legal procedures regulating the withdrawal of lands.
